I. THERE ARE TWO METHODS TO PROVE EB-1 ALIEN OF EXTRAORDINARY ABILITY

A. Sustained National Or International Acclaim

The first method to prove EB-1 is to establish a “sustained national or international acclaim” through the evidence of a one-time achievement such as a major, international recognized award. This requirement is difficult to satisfy, because USCIS not recognize prestigious national award, or a minor international award.  USCIS requires a major international recognized award.

B. Prove Sustained National Or International Acclaim Through At Least 3 Of The Following 10 Requirements

A second and easier method to prove EB-1 Alien of Extraordinary Ability is to submit at least three types of the following evidence:

1. Receipt of lesser nationally or internationally recognized prizes or awards for excellence.

2. Membership in associations which require outstanding achievements of their members, as judged by recognized national or international experts.

3. Published material in professional or major trade publications or major media about the alien and relating to the alien's work.

4. Participation, on a panel or individually, as a judge of the work of others in the same field.

5. Original scientific, scholarly, or artistic contributions of major significance.

6. Authorship of scholarly article in professional journals or other media.

7. Work displayed in artistic exhibitions or showcases.

8. Performing a leading or critical role for organizations or establishments that have a distinguished reputation.

9. High salary or remuneration in comparison to others in the same field.

10. Commercial success in the performing arts, demonstrated through box office receipts, record sales, or video sales.

USCIS requires the fulfillment of the evidence to be more than the minimum.  If USCIS does not believe that you are truly one of the very few that have risen to the top of their field, then your petition will fail.  The following sections shall discuss each requirement in detail.
